TERMS OF USE AND GENERAL TERMS AND CONDITIONS

Welcome to the Diamond Vestis store (“Diamond Vestis”, “we”, “us”, “our”). These Terms of Use and General Terms and Conditions (“Terms”) govern the use of our website, online store, auctions, and related services (“Services”).

Our store is built on the Shopify platform, which technically enables us to provide the Services, but all contractual relationships arise exclusively between you and Diamond Vestis s. r. o.

By using our website, placing an order, or participating in an auction, you confirm that you have read these Terms, understand them, and agree to be bound by them.

1. ACCESS AND ACCOUNT

1.1. By using the Services, you confirm that:

  • you are at least 18 years old (or of legal age in your country of residence),
  • you have the legal capacity to enter into binding contracts.

1.2. When making a purchase or participating in an auction, you may be required to create an account (Shopify account / account in our online store). You agree to:

  • provide accurate, current, and complete information,
  • keep your login credentials secure,
  • inform us without undue delay if you suspect any misuse of your account.

1.3. The account is non-transferable – you must not sell, rent, or otherwise provide it to any third party.

2. OUR PRODUCTS

2.1. Diamond Vestis specializes primarily in:

  • luxury coats,
  • made-to-measure coats,
  • limited collections and coats sold via auction.

2.2. We strive to present products as accurately as possible (photos, descriptions, visualizations), however:

  • colors and appearance may vary depending on the device, screen settings, or lighting conditions,
  • minor variations due to handcrafting (stitching, embroidery, fur density, etc.) are a natural feature of handmade products and are not considered defects.

2.3. We reserve the right to:

  • change product descriptions, availability, or prices at any time,
  • discontinue the sale of a particular product,
  • limit the quantity of items per customer or per order.

3. ORDERS IN THE ONLINE STORE (NON-AUCTION)

3.1. By submitting an order through the online store, you are making an offer to conclude a purchase contract.

3.2. The purchase contract is concluded at the moment when:

  • we confirm the acceptance of your order by e-mail, or
  • we confirm that we have received your payment (whichever occurs first).

3.3. We reserve the right to:

  • reject an order,
  • cancel or modify an order,

especially in the following cases:

  • obvious error in price,
  • product unavailability,
  • suspected misuse or fraudulent activity.

3.4. Please carefully check your order before submitting it. Once the contract has been concluded, changes or cancellation may no longer be possible.

3.5. Purchases are intended for the customer’s personal use, not for further resale in wholesale mode.

4. AUCTIONS OF READY-MADE COATS

4.1. Some ready-made and unique coats are sold via online auction directly on our website.

4.2. Who may participate in an auction
Participation in auctions is only possible for registered users who:

  • are of legal age,
  • have an active account and a valid contact e-mail,
  • agree to these Terms.

4.3. Course of the auction

  • Each auction product displays the current price (current highest bid) and possibly the minimum bid increment and/or automatic bidding (if this feature is available).
  • Your bid is a binding offer to purchase the given coat.
  • After the auction ends, the highest valid bid becomes the winning bid, provided that any hidden reserve price (if used) has been met.

4.4. Auction winner

  • The winner will be notified by e-mail (and/or via account notification in the online store) after the auction ends.
  • The winner is required to pay the winning bid price within the period specified for the auction or in the e-mail (typically e.g. 7 calendar days).
  • If the winner fails to pay within the specified period, we may:
    • cancel the auction,
    • offer the coat to the next bidder (second highest bid),
    • or list the coat in a new auction.

4.5. Final price and shipping

  • The auction price applies to the coat itself.
  • Shipping, handling, customs, and other fees may be charged separately depending on the delivery destination and shipping method.
  • The final price including shipping will be shown to you before you confirm your payment.

4.6. Difference between auction items and made-to-measure coats

  • Coats sold in auctions are finished pieces offered as existing, unique items.
  • Made-to-measure coats based on the customer’s individual requirements are not part of the auctions and their price is determined individually according to the chosen materials and complexity.

4.7. We reserve the right to:

  • cancel or modify an auction before its end in the event of technical errors, misuse, or other serious reasons,
  • reject a bid in case of suspected fraudulent or harmful conduct.

5. PRICES, PAYMENTS AND INVOICING

5.1. All prices are displayed in the currency selected for the given market (typically EUR) and:

  • may include or exclude VAT depending on applicable legislation and the settings in our online store (this information is provided on the website),
  • do not include shipping, customs duties, or other charges unless explicitly stated otherwise.

5.2. The price of a product or auction coat is determined by:

  • a fixed price in the online store, or
  • the final auction price (for auctions).

5.3. By making a payment you confirm that:

  • you are authorized to use the selected payment method,
  • all information provided is truthful and complete.

5.4. Payments are processed via:

  • a payment gateway (cards, digital wallets, and other methods supported by Shopify or our payment provider),
  • other methods specified on our website, if available.

5.5. We reserve the right to:

  • change prices, discounts, and promotions without prior notice,
  • decline a transaction if it is not authorized by the payment provider.

6. SHIPPING AND DELIVERY

6.1. Available shipping methods, estimated delivery times, and costs are displayed during the checkout process.

6.2. The stated delivery times are approximate and not guaranteed. We are not liable for:

  • delays caused by the carrier, customs authorities, or circumstances beyond our reasonable control.

6.3. Title and risk of loss or damage to the goods pass to you at the moment of:

  • handing the goods over to the carrier (in case of shipment), or
  • personal collection.

7. RETURNS, EXCHANGES AND CLAIMS

7.1. Detailed conditions for returns, exchanges, and claims are set out in the document “Return and Refund Policy”, which forms part of our website.

7.2. In general:

  • for standard in-stock products you may have a statutory right to withdraw from the contract within a legal period (if you are purchasing as a consumer),
  • for products made to measure and according to your individual specifications the right of withdrawal may be restricted or excluded in accordance with applicable law – such products are labeled as “custom-made” or “made to measure”.

7.3. Products labeled as “final sale” cannot be returned unless they are defective.

7.4. Claims are handled in accordance with applicable laws of the Slovak Republic. The exact procedure (where to write, what to provide, deadlines) is described in our Return Policy.

8. INTELLECTUAL PROPERTY

8.1. All content of the Services, in particular:

  • the Diamond Vestis name and logo,
  • coat designs, patterns, 3D visualizations, photographs, texts, graphics, videos,

is protected by intellectual property rights and is owned by Diamond Vestis or our partners/licensors.

8.2. Without our prior written consent, you must not:

  • copy, modify, distribute, publicly display, or use our materials for commercial purposes,
  • create derivative works based on our designs, visualizations, or texts.

8.3. The names, logos, and trademarks of Shopify are the property of Shopify and must not be used without its consent.

9. THIRD-PARTY TOOLS AND SERVICES

9.1. Within the Services, you may use third-party tools (e.g., payment gateways, auction apps, add-ons).

9.2. These tools are provided and operated by third parties which:

  • we do not control,
  • we are not responsible for their operation, security, or content.

9.3. You use such tools at your own risk and we recommend reviewing the terms and conditions of these third parties.

10. THIRD-PARTY LINKS

10.1. Our website may contain links to third-party websites or services.

10.2. We are not responsible for:

  • the content of such websites,
  • their security,
  • products or services they offer.

11. RELATIONSHIP WITH SHOPIFY

11.1. Our online store is hosted on the Shopify platform, which technically enables us to operate the Services.

11.2. All contracts, purchases, and obligations arise between you and Diamond Vestis s. r. o.
By using the Services, you acknowledge that Shopify:

  • is not responsible for the content of our website, products, auctions, or delivery,
  • is not liable for damages arising in connection with purchases in our store.

12. DATA PROTECTION

12.1. The processing of personal data is governed by our Privacy Policy, which is available on our website.

12.2. By using the Services, you confirm that you have familiarized yourself with this Privacy Policy.

13. FEEDBACK AND REVIEWS

13.1. If you submit a review, feedback, idea, photo, or suggestion to us, you:

  • grant us a non-exclusive right to use, display, and adapt such content for marketing and presentation purposes (e.g., on the website, social media),
  • represent that you have the rights to such content (you are the author or have permission) and that such content does not infringe the rights of third parties.

13.2. We reserve the right to:

  • not publish, modify, or remove feedback that is offensive, unlawful, misleading, or violates these Terms.

14. ERRORS, INACCURACIES AND OMISSIONS

14.1. Occasionally, errors or inaccuracies may appear in product descriptions, prices, availability, or shipping information.

14.2. We reserve the right to:

  • correct such errors,
  • change or update information,
  • cancel or modify orders

even after they have been submitted, if they were based on an obvious error.

15. PROHIBITED USE OF THE SERVICES

15.1. You must not use the Services:

  • for unlawful purposes,
  • to infringe intellectual property rights,
  • to abuse auctions or payment systems,
  • to distribute malicious code, spam, attacks, or attempts to gain unauthorized access to the system.

15.2. We reserve the right to:

  • block your account,
  • cancel orders or bids,

if we detect a breach of these Terms.

16. WARRANTIES AND LIMITATION OF LIABILITY

16.1. The Services are provided “as is” and “as available”. We do not warrant:

  • uninterrupted availability,
  • error-free operation of the online store or auctions,
  • that all information will always be current, complete, and error-free.

16.2. To the maximum extent permitted by law, we are not liable for:

  • loss of profit or business opportunities,
  • indirect, consequential, or punitive damages,
  • damages caused by circumstances beyond our reasonable control.

This does not affect your statutory consumer rights under the applicable laws of the Slovak Republic / EU.

17. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, and costs (including reasonable legal fees) arising from:

  • your breach of these Terms,
  • violation of third-party rights,
  • misuse of the Services or auctions.

18. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. ASSIGNMENT

You may not assign any of your rights or obligations under these Terms to a third party without our prior written consent.
We may transfer our rights and obligations to another entity (for example, in connection with a change of ownership of the company).

20. GOVERNING LAW AND DISPUTE RESOLUTION

20.1. These Terms and all contractual relationships are governed by the laws of the Slovak Republic.

20.2. We will strive to resolve any disputes amicably first. If this is not possible, the dispute shall be resolved by:

  • the competent court of the Slovak Republic according to the registered office of Diamond Vestis s. r. o.

20.3. If you are a consumer, you also have the right to contact a body for alternative dispute resolution (ADR) in accordance with applicable legislation.

21. CHANGES TO THE TERMS

21.1. The current version of the Terms is always available on our website.

21.2. We reserve the right to:

  • update,
  • change, or
  • supplement these Terms.

Material changes will be communicated in an appropriate manner (e.g., website notice or e-mail).
By continuing to use the Services after the changes take effect, you agree to the updated Terms.
